Terms and Conditions
These terms & conditions of the Membership Agreement under which you agree to become a member of Zen Head. When you purchase a Zen Head membership you are entering into a legally binding Membership Agreement Form.
This agreement is made up of the Membership Details, Terms & Conditions and Special Conditions contained in the Membership Agreement Form including the Terms & Conditions listed below.
This form sets out your rights to use our exercise facilities and services, and the obligations you have to comply with as a member. Your responsibilities under this agreement, including payment of membership fees, do not depend on how often you use the facilities and services. You promise to tell us if at any time you believe that you may not be able to comply with your obligations under this agreement including payment of fees, so we can discuss your options with you.
Please read through this entire form carefully to make sure that it fully reflects your expectations. Please ask us or seek advice if you are unsure whether any particular statements that you have relied on are part of this agreement. You agree that you will not later say that you relied on any other statements made by us or you.
These Terms use plain language, to ensure words and concepts used are easily understood. For instance, we have included clause headings as a guide, but these do not form part of this agreement. Certain recurring words are defined in the details and elsewhere in this agreement and other forms of those words have equivalent meaning.
If you change your mind shortly after applying for a membership. You may have an opportunity to cancel. You will need to let us know in writing within 48 hours of purchasing a membership to be effective. We will charge fair amounts for services we have already provided but will otherwise refund you any other amounts you have paid to us within 7 days. If you wish to end your membership otherwise, different terms apply as set out below.
Please keep your contact details up to date. You promise to tell us promptly if you change your address, phone number, email, bank account, credit card information for payment or if there is a change to any other peroneal information relevant to your membership with us. This includes any matters that affect the health and safety of you or others.
What you get when you join
From the time and date you purchase a Membership you are entitled to the membership benefits and use of the facilities and services that apply to the Membership Type you selected.

All Membership types can only be used by You (the purchasee ) and cannot be shared with another Zen Head member or a person outside of a Zen Head membership. All class bookings must be made with your name and email address.
You can transfer your membership to another person (transferee) within the minimum term of your membership as long as the transferee:
• completes the new membership sign-up process
• is eligible to take up your membership
• has not previously been banned by Zen Head or failed to pay membership fees. The transfer is effective only after the transferee has completed the sign-up process. We do not allow transfers once you have completed your minimum term.
Membership Termination By You
Memberships can be cancelled after the minimum 8 week term by emailing firstname.lastname@example.org and giving 7 days notice.
As Memberships are paid in advance please ensure that you allow enough notice for termination, no refunds can be awarded once a transaction has been made if you fail to give us adequate notice.
All memberships are ongoing and will continue after the minimum term of 8 weeks until terminated by you. Memberships cannot be terminated before 8 weeks except under circumstances deemed extenuating by Zen Head. This is due to the substantial discount on class prices when paying by a membership as appose to a casual class pass.
Cancellations due to serious illness or permanent physical incapacity must be in writing and will only be considered upon presentation of a letter from a specialist medical practitioner, currently practicing in a field relevant to your condition or illness, outlining specifically how your condition prevents you from using Zen Head services for the duration of your minimum term.
Membership Termination by Zen Head
Zen Head may at any time terminate your membership in writing if:
A serious breach of the terms and conditions is committed. If Zen Head has given you notice that a serious breach has been committed and you have not remedied the breach within 14 days of receiving the notice.
Membership dues are outstanding, you will locked out of your Zen Head account which prevents you from booking future classes.
If membership is terminated for any of these reasons we may take steps to recover any reasonable costs which are incurred as a result of your breach and all outstanding membership fees payable. We may use a third party to assist in the collection of outstanding fees.
A membership can be placed on hold (suspension of payments) under the terms of your Membership Agreement. You may temporarily suspend your membership if all amounts payable for your membership are paid up to date. You must apply for a hold at least 3 days prior to your requested start date via email to email@example.com. Memberships can be put on hold for maximum of four (4) weeks in one calendar year, and does not exceed these 4 weeks, with a minimum of 7 days.
The period of any membership hold will be added to its Minimum Term so that the sum of the instalments payable for the Minimum Term shall remain the same regardless of any membership hold.
No fee shall apply for the period of the membership hold.
Payments By Direct Debits
You agree to pay the membership instalment amount each week by direct debit until this Agreement is terminated in accordance with terms outlined within this agreement.
Memberships commence on the day you join and your first payment is debited the same day. Memberships are debited weekly and your payment cycle is weekly from the day that you join. E.g. If you join on a Monday, you will have a payment that day and then your next payment will be debited the following Monday.
You acknowledge that Stripe has been engaged by Zen Head to collect the fees due under this agreement.
By nominating a credit or debit account, you are authorising Stripe to deduct from that account all fees and other charges for which you may be responsible under this agreement. Accordingly, it is essential that you keep your account details up to date.
It is your responsibility to ensure that on the due date clear funds are available in your nominated account to meet the direct debit payment. Should there be any arrears in payments your account will be locked until you have paid the outstanding fees.
Debiting Membership (ongoing)
Your Membership will continue after the Minimum Term unless you tell us in writing at any time that you do not wish your membership to continue. After the Minimum Term you can terminate at any time by notifying us via email fourteen (14) days prior. Within 7 days of receiving such notice, we will send you written confirmation of cancellation. If you do not receive the written confirmation, you should contact us immediately. In the event of you terminating, a termination fee equivalent to two (2) direct debits is payable. You can continue the use of the facility up to the end of that 14-day term.
There may be other services offered within Zen Head that do not form part of your membership type but are available for you to purchase separately. These are not part of the services provided under your membership and you will be advised at the time if any additional terms apply to these services
Changes To Your Membership Agreement
We may need to make changes to this agreement during your membership. However, we will always try to do this in a way that is fair by giving you an opportunity to cancel your membership if you do not agree to the change. We will tell you in writing of the proposed change in advance and tell you the date that it will come into effect.
Please note you cannot cancel under this clause if we are required to make any changes in order to comply with a law or any direction of a competent or government authority.
We are not liable if you cannot use your membership due to anything beyond our reasonable control. If that failure or delay continues for more than 30 days, then we can cancel this agreement with immediate effect by informing you in writing. We are entitled to make part or all of the facilities unavailable for up to two weeks during each calendar year due to studio holiday closure or to undertake maintenance, repairs or improvements, in which case we will extend your membership by the time you are unable to use our facilities.
It is the member’s responsibility to use facilities as directed. Members must adhere to all signs and directions from Zen Head staff. Members will be responsible for any damage that is caused through a wilful act or negligence.
