Terms and Conditions

These terms & conditions of the Membership Agreement under which you agree to become a member of Zen Head. When you purchase a Zen Head membership you are entering into a legally binding Membership Agreement Form.

This agreement is made up of the Membership Details, Terms & Conditions and Special Conditions contained in the Membership Agreement Form including the Terms & Conditions listed below.

This form sets out your rights to use our exercise facilities and services, and the obligations you have to comply with as a member. Your responsibilities under this agreement, including payment of membership fees, do not depend on how often you use the facilities and services. You promise to tell us if at any time you believe that you may not be able to comply with your obligations under this agreement including payment of fees, so we can discuss your options with you.

Please read through this entire form carefully to make sure that it fully reflects your expectations. Please ask us or seek advice if you are unsure whether any particular statements that you have relied on are part of this agreement. You agree that you will not later say that you relied on any other statements made by us or you.

Plain terms

These Terms use plain language, to ensure words and concepts used are easily understood. For instance, we have included clause headings as a guide, but these do not form part of this agreement. Certain recurring words are defined in the details and elsewhere in this agreement and other forms of those words have equivalent meaning.

Membership Purchases

All purchases are final, there are  no refunds for membership instalments, payments or trial offers. 

Privacy

From when you purchase a Membership we will have access to personal information about you, such as information relating to your health and finances. We will protect this information and only use, disclose or deal with this information in accordance with our Privacy Policy. The latest version of the Privacy Policy will be available here.

Please keep your contact details up to date. You promise to tell us promptly if you change your address, phone number, email, bank account, credit card information for payment or if there is a change to any other peroneal information relevant to your membership with us. This includes any matters that affect the health and safety of you or others.

What you get when you join

From the time  and date you purchase a Membership you are entitled to the membership benefits and use of the facilities and services that apply to the Membership Type you selected.

Single Casual Visit
Single Casual visits are available for a single casual pass.

1 Month Class Pass
1 Month Class Pass give you access to 4 class visits with a 30 day expiry date. The activation date is the date of purchase of 1 Month Class Pass and the class pack will expire 30 days from the date of purchase.

10 Class Pass
All 10 Class Pass have a 90 day expiry date. The activation date is the date of purchase of 10 class pass and the class pack will expire 90 days from the date of purchase.

Class Pass Terms

All class passes and trial offers can be redeemed for classes only. They are not redeemable for cash. Class passes and trial offers are only valid only for scheduled one hour classes on our core timetable, and cannot be used for attendance at feature classes, workshops, courses, or events.

Class passes and trial offers are valid for the period indicated regardless of Public Holidays or any other scheduled studio closure in that period. Class passes become invalid after expiry.

Zen Head Meditation studio does not offer refunds, suspensions, or extensions on class passes for change of mind, injury, illness, change of address, or any other reason. All purchases are final. All class passes and trial offers are non-refundable and unused class pass credits 

Unused class pass visits are void after the date of expiry. Unused Membership class visits do not roll over.

Zen Head Meditation studio may transfer a class pass pack to 1 nominated person only within the valid time frame of when the class pass pack was purchased. Original expiry date remains and no extensions will be given.

Cancelations
Any non-cancellations, no-shows, or absences, will result in forfeiting that visit. If you do not attend a booked session or cancel within 4 hours of the class start time, you will be charged for the class or a deduction will be made on class pack passes.

Zen Head reserves the right to terminate any person’s class, class pass or membership at any time as a result of behaviour that we deem inappropriate, including but not limited to repeated no-shows or failed/overdue payments, harassment of staff or other students, damage or theft of studio property, and discriminatory or derogatory behaviour.

Zen Head Meditation studio is not responsible if a class pass holders cannot use Zen Head’s services or facilities because of an event caused by a natural force such as COVID-19 restrictions, extreme weather, or something similar beyond our reasonable control.

Refunds

Refunds will not be given on class passes and 2 week trial visits. All purchases are final.

Refunds will not be given if the member is unable to use their class pass or trial offer after the date of expiry.

Refunds will not be given on class passes, but can be transferred to another member before the expiration date and not after.

Refunds or extensions will not be given for unused class visits on Class Passes or Memberships.

Refunds or extensions will not be given expired passes.

A $20 administrative fee will be charged for the rare occasion a refund is given.

Membership usage

All Membership types can only be used by You (the purchasee ) and cannot be shared with another Zen Head member or a person outside of a Zen Head membership. All class bookings must be made with your name and email address.

Transferring Memberships

You can transfer your membership to another person (transferee) within the minimum term of your membership as long as the transferee:

• completes the new membership sign-up process

• is eligible to take up your membership

• has not previously been banned by Zen Head or failed to pay membership fees. The transfer is effective only after the transferee has completed the sign-up process. We do not allow transfers once you have completed your minimum term.

Membership Termination By You

Memberships can be cancelled after the minimum 4 week term by emailing zenhead.info@gmail.com and giving 7 days notice.

As Memberships are paid in advance please ensure that you allow enough notice for termination, no refunds can be awarded once a transaction has been made if you fail to give us adequate notice.

All memberships are ongoing and will continue after the minimum term of 4 weeks until terminated by you. Memberships cannot be terminated before 8 weeks except under circumstances deemed extenuating by Zen Head. This is due to the substantial discount on class prices when paying by a membership as appose to a casual class pass.

Cancellations due to serious illness or permanent physical incapacity must be in writing and will only be considered upon presentation of a letter from a specialist medical practitioner, currently practicing in a field relevant to your condition or illness, outlining specifically how your condition prevents you from using Zen Head services for the duration of your minimum term.

Membership Termination by Zen Head

Zen Head may at any time terminate your membership in writing if:

A serious breach of the terms and conditions is committed. If Zen Head has given you notice that a serious breach has been committed and you have not remedied the breach within 14 days of receiving the notice.

Membership dues are outstanding, you will locked out of your Zen Head account which prevents you from booking future classes.

If membership is terminated for any of these reasons we may take steps to recover any reasonable costs which are incurred as a result of your breach and all outstanding membership fees payable. We may use a third party to assist in the collection of outstanding fees.

Membership Suspension

A membership can be placed on hold (suspension of payments) under the terms of your Membership Agreement. You may temporarily suspend your membership if all amounts payable for your membership are paid up to date. You must apply for a hold at least 3 days prior to your requested start date via email to zenhead.info@gmail.com.  Memberships can be put on hold for maximum of four (4) weeks in one calendar year, and does not exceed these 4 weeks, with a minimum of 7 days.

The period of any membership hold will be added to its Minimum Term so that the sum of the instalments payable for the Minimum Term shall remain the same regardless of any membership hold.

No fee shall apply for the period of the membership hold.

Payments By Direct Debits

All customers signing up for Zen Head Memberships or Trial Offers will be required to submit payment card details as part of the process. By submitting your payment details, you accept and consent to us using your payment details to allow automatic payments and direct debits to occur.

You agree to pay the membership instalment amount each week by direct debit until the Membership or Trial Offer is terminated in accordance with terms outlined within this agreement.

Memberships commence on the day you join and your first payment is debited the same day. Memberships are debited weekly and your payment cycle is weekly from the day that you join. E.g. If you join on a Monday, you will have a payment that day and then your next payment will be debited the following Monday.

You acknowledge that Stripe has been engaged by Zen Head to collect the fees due under this agreement.

By nominating a credit or debit account, you are authorising Stripe to deduct from that account all fees and other charges for which you may be responsible under this agreement. Accordingly, it is essential that you keep your account details up to date.

It is your responsibility to ensure that on the due date clear funds are available in your nominated account to meet the direct debit payment. Should there be any arrears in payments your account will be locked until you have paid the outstanding fees.

Debiting Membership (ongoing)

Your Membership will continue after the Minimum Term unless you tell us in writing at any time that you do not wish your membership to continue. After the Minimum Term you can terminate at any time by notifying us via email fourteen (14) days prior. Within seven (7) days of receiving such notice, we will send you written confirmation of cancellation. If you do not receive the written confirmation, you should contact us immediately. In the event of you terminating, a termination fee equivalent to two (2) direct debits is payable. You can continue the use of the facility up to the end of that 14-day term.

Other Services

There may be other services offered within Zen Head that do not form part of your membership type but are available for you to purchase separately. These are not part of the services provided under your membership and you will be advised at the time if any additional terms apply to these services

Changes To Your Membership Agreement

We may need to make changes to this agreement during your membership. However, we will always try to do this in a way that is fair by giving you an opportunity to cancel your membership if you do not agree to the change. We will tell you in writing of the proposed change in advance and tell you the date that it will come into effect.

Please note you cannot cancel under this clause if we are required to make any changes in order to comply with a law or any direction of a competent or government authority.

Unexpected Events

We are not liable if you cannot use your membership due to anything beyond our reasonable control. If that failure or delay continues for more than 30 days, then we can cancel this agreement with immediate effect by informing you in writing. We are entitled to make part or all of the facilities unavailable for up to two weeks during each calendar year due to studio holiday closure or to undertake maintenance, repairs or improvements, in which case we will extend your membership by the time you are unable to use our facilities.

Liability

It is the member’s responsibility to use facilities as directed. Members must adhere to all signs and directions from Zen Head staff. Members will be responsible for any damage that is caused through a wilful act or negligence.

$1 For 1 Week Trial Offer Terms and Conditions
Terms: $1 for 1 week (7 days) trial offer: Seven (7) Days for AUD$1, then AUD$20 per week.

The following terms and conditions will apply if you have a $1 For 1 Week Trial Offer:-

  1. The $1 For 1 Week Trial Offer will last for a period of seven (7) days only. After the seven day trial, regular price for One Class Per Week Membership will be charged.
  2. The offer $1 For 1 Week Trial Offer entitles you unlimited access to Zen Head Meditation Classes at Shop 1/247 Milne Rd, Modbury North and unlimited access to the Zen Head Online Meditation Library for a period of seven (7) days from the moment that you purchase this trial offer.
  3. All customers signing up for $1 For 1 Week Trial Offer will be required to submit payment card details as part of the process. By submitting your payment details, you accept the $1 For 1 Week Trial Offer and consent to us using your payment details to allow automatic payments once the seven day trial period finishes.
  4. If you decide you do not want to become a paying user of Zen Head One Class Per Week Membership once the seven day trial period ends, you must cancel the $1 For 1 Week Trial Offer, 3 business days before the seven day trial period ends.
  5. Once the seven day trial offer ends you will be automatically be charged the One Class Per Week Membership of AUD$20 per week.
  6. No extensions can be given due to the heavily discounted nature of the trail offer.
  7. The $1 For 1 Week Trial Offer is only available once for first time students to Zen Head Meditation studio.
  8. Notice will be sent if payment fails for any reason. It is the customers responsibility to make sure payment details are correct to allow successful renewal payments.
  9. Zen Head reserves the right, in its absolute discretion, to withdraw or to modify the $1 For 1 Week Trial Offer and/or the $1 For 1 Week Trial Offer Terms and Condition at any time without prior notice and with no liability.
  10. Zen Head reserves the right to remove or cancel the free trial offer at any time.
  11. Zen Head reserves the right to change the features of the free trial offer at any time.
